1. Acceptance of Terms

Welcome to PanelVerse Comics, a platform dedicated to helping you craft compelling visual stories through the art of comics. By accessing or using PanelVerse Comics, including our website, programs, and services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services. These Terms constitute a legally binding agreement between you and PanelVerse Comics, located at 123 Comic Avenue, Suite 400, San Francisco, CA 94107.

2. Description of Services

PanelVerse Comics provides a range of services related to comic storytelling and creation, including but not limited to:

3. User Accounts

You retain all rights to your User Content, and you are solely responsible for the content you submit. By submitting User Content to PanelVerse Comics, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the PanelVerse Comics services and our business, including without limitation for promoting and redistributing part or all of the PanelVerse Comics services (and derivative works thereof) in any media formats and through any media channels.

You represent and warrant that you have all the rights necessary to grant the licenses in this section and that your User Content does not violate any third-party rights, including copyright, trademark, privacy, or publicity rights, or any applicable laws or regulations. You agree not to submit User Content that is defamatory, obscene, abusive, illegal, or otherwise objectionable.

PanelVerse Comics reserves the right to remove or disable access to any User Content that violates these Terms or that we deem inappropriate for any reason, without prior notice.

5. Intellectual Property

All content included on PanelVerse Comics, such as text, graphics, logos, images, audio clips, video clips, and software, is the property of PanelVerse Comics or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, modify, distribute, or display any of our intellectual property without our prior written consent.

The PanelVerse Comics name and logo are trademarks of PanelVerse Comics. You may not use these trademarks without our prior written consent.

6. Payment and Subscription Terms

Some of our services require payment of fees. By subscribing to a paid service, you agree to pay the applicable fees as described on our website. Fees are non-refundable, except as expressly stated in our refund policy. Subscription fees are billed in advance on a recurring basis (e.g., monthly or annually) until you cancel your subscription.

You can cancel your subscription at any time through your account settings. Your cancellation will take effect at the end of the current billing cycle. We reserve the right to change our fees or billing methods at any time, provided that we give you reasonable advance notice of any such changes.

All payments are processed securely through our third-party payment processor, Stripe. PanelVerse Comics does not store your credit card information.

7. Limitation of Liability

To the fullest extent permitted by applicable law, PanelVerse Comics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use PanelVerse Comics; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from PanelVerse Comics; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through PanelVerse Comics by any third party; (e) any errors or omissions in any content; or (f) any defamatory, offensive, or illegal conduct of any third party.

In no event shall PanelVerse Comics's total liability to you for all damages, losses, and causes of action exceed the amount you have paid to PanelVerse Comics in the twelve (12) months preceding the date the claim arose.

8. Disclaimer of Warranties

PanelVerse Comics is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that PanelVerse Comics will be uninterrupted, secure, or error-free. We do not warrant the accuracy, completeness, or usefulness of any information on PanelVerse Comics.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in San Francisco, California, and you consent to the jurisdiction of such courts.
